To the fullest extent permitted by Philippine law, ph03 and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to loss of profits, loss of data, or loss of goodwill, even if ph03 has been advised of the possibility of such damages.
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. ph03 does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
In no event shall ph03's total liability to you for all claims arising out of or related to these Terms or your use of the Platform exceed the amount of funds deposited into your account during the six (6) months preceding the event giving rise to liability.
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or your use of the Platform shall be resolved through good faith negotiation between the parties.
If a dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. The arbitration shall be conducted in Metro Manila, Philippines, and the language of arbitration shall be English. The decision of the arbitrator shall be final and binding on both parties.
Notwithstanding the foregoing, ph03 reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our intellectual property rights or other proprietary rights.
